AcuNett.com agrees to provide services to the Customer subject to the following Terms of Service (“TOS”), Acceptable Usage Policy (“AUP”), and Privacy Policy.
Service Operator: AcuNett.com is a service brand operated by Elevology, Inc. References to “AcuNett,” “Company,” “we,” or “our” refer to the operator of the AcuNett.com services.
AcuNett.com reserves the right to modify these Terms of Service or policies at any time. Continued use of services following such changes constitutes acceptance of the updated terms. “Service” refers to any service provided through AcuNett.com to the Customer.
Service Continuity and Ownership Transfer: Customer acknowledges that AcuNett.com services and related infrastructure may be operated, assigned, or transferred to a successor operator. In the event of such transfer, customer accounts, service records, and operational infrastructure may be migrated to the new operator for the purpose of continuing services. Continued use of services following such transfer constitutes acceptance of the successor operator as the service provider.
Data / Security / Uptime: AcuNett.com strives to maintain reliable systems and protect the integrity of customer environments. However, due to the complex nature of server infrastructure, internet connectivity, and third-party services, uninterrupted operation cannot be guaranteed. In certain cases the Company may offer service credits or compensation at its sole discretion.
Customer agrees to defend, indemnify, and hold harmless the Company from liabilities resulting from any content, software, or activity conducted on systems managed or supported by the Customer.
Payments and Fees: Establishment of service is dependent upon receipt of payment for the stated charges. Subsequent payments are due on the monthly anniversary date for that month’s service unless otherwise agreed.
Failure to Pay: The Company may suspend or terminate services upon failure of Customer to pay charges when due. Such termination does not relieve Customer of responsibility for payment of all accrued charges.
Cancellations / Refunds: Fees are generally non-refundable unless determined otherwise by the Company. Customers may cancel services at any time by submitting a cancellation request through the billing or support system.
Third-Party Infrastructure: Services may rely on third-party providers including datacenters, cloud platforms, network carriers, and software vendors. AcuNett.com is not responsible for outages, service interruptions, hardware failures, or performance issues caused by such third-party infrastructure providers.
Customer Data Responsibility: Customers are solely responsible for all data, applications, and content hosted or operated on their systems. AcuNett.com does not monitor or control customer content except as required to provide services or comply with legal obligations.
Backup Responsibility: Customers are responsible for maintaining independent backups of all systems and data. AcuNett.com does not guarantee recovery of customer data unless explicitly stated in a separate written agreement.
Confidentiality: AcuNett.com will treat customer information, credentials, and system access details as confidential and will only use such information as necessary to perform services. Information may be shared with employees, contractors, or service providers when required for operational purposes.
Administrative Access and Operational Risk: To provide technical services, AcuNett.com personnel may require administrative, root, or equivalent privileged access to customer systems. By granting such access, the Customer acknowledges that system administration involves operational risk. Maintenance, updates, security actions, or configuration changes may affect system behavior, compatibility, or uptime. Actions performed in good faith to maintain or restore service functionality shall not create additional liability for the Company.
Best Effort Services: Technical support and system administration are provided on a best-effort basis. While AcuNett.com strives to provide high-quality assistance, no guarantee is made that any specific issue will be resolved or that services will be uninterrupted. Resolution times and outcomes may depend on third-party infrastructure, hardware conditions, software compatibility, or other factors outside the Company’s control.
Customer Conduct and Acceptable Use: Customer agrees not to use services for unlawful activities, security violations, intellectual property infringement, abusive behavior, malware distribution, spam, or other activities that may harm networks or systems. The Company reserves the right to suspend services immediately if such activity is detected.
Service Suspension: AcuNett.com reserves the right to suspend or restrict services immediately if a system causes security threats, network abuse, unlawful activity, or disruption to other customers or infrastructure.
Limitation of Liability: YOU UNDERSTAND AND AGREE THAT ACUNETT.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES INCLUDING LOSS OF PROFITS, DATA, BUSINESS INTERRUPTION, OR GOODWILL ARISING FROM USE OR INABILITY TO USE THE SERVICES.
In all cases, the Company’s total liability shall not exceed the amount paid by the Customer for services during the ninety (90) days prior to the event giving rise to the claim.
THE CUSTOMER AGREES TO USE ACUNETT.COM SERVICES AT THEIR OWN RISK.
Governing Law: These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Texas, United States.
If you do not accept or understand any part of these Terms of Service, you should not use our services. Continued use of AcuNett.com services constitutes acceptance of these terms.
